This is a synopsis of the Saline County Board of Commissioners’ February 16, 2021, regular meeting proceedings. A complete set of the proceedings is on file in the Board of Commissioners’ Journal, is of public record in the Saline County Clerk’s office and on our website: www.co.saline.ne.us SALINE COUNTY BOARD OF COMMISSIONERS The regular meeting of the Saline County Board of Commissioners was called to order at 9:40 a.m. on Tuesday, February 16, 2021, by Chairperson Russ Karpisek. Present were Karpisek, Marvin A. Kohout, Janet J. Henning, Philip Hardenburger and Stephanie A. Krivohlavek, County Clerk Anita K. Bartels, and Administrative Assistant Tim McDermott. County Attorney Tad Eickman was present between court commitments. Notice of said meeting was posted in the County Clerk’s Office, on the Saline County Website, and published in all three county newspapers prior to the meeting, in compliance with State Statutes; Let the record show that all proceedings are electronically recorded; Approved the agenda as presented; Approved the minutes of the February 2, 2021, regular meeting; Under Citizens Forum, Jeff Koll addressed the Board, thanking them for streaming live the last Planning & Zoning meeting and requested the meetings continue to be streamed. He requested considering recording them via YouTube, thereby not depending on real time internet connections. Koll inquired which Saline County committees have By-Laws. Koll reported Sandra Koll filed a complaint with the State of Nebraska, Office of the Attorney General, regarding alleged violations of the Open Meetings Act, Neb. Rev. Stat. §§84-1407 to 84-1414 by the Saline County Planning and Zoning Administrator. Upon completion of their process, her complaint was reviewed to determine if the situation warranted immediate action by their office for knowing violations of the Open Meeting Act. The Nebraska Office of the Attorney General determined that it did not. There is insufficient evidence to determine whether the Planning & Zoning Board failed to publish notice of its January 22, 2020, meeting or improperly amended the February 19, 2020, agenda. While contemplating no further action regarding this complaint, the Planning & Zoning Board was admonished through this letter that strict compliance with the Open Meetings Ace in the future is imperative. Gary Veprovsky thanked the responsible party for correctly posting the Planning & Zoning Board minutes. Veprovsky reported Gerald Horak had contacted him stating he was disappointed in only receiving a response from Karpisek, when he sent correspondence regarding his disapproval of wind development, to all the members of the Board of Commissioners. Under Correspondence, Bartels reported receiving from Blue Valley Community Action their February 16th agenda, minutes of their January 19th zoom meeting and the February 2021 Reports to the BVCA Board; from Blue Valley Behavioral Heath a report in the first 6 months of this fiscal year, they have seen and treated 36 substance abuse Saline County clients; email and phone correspondence with Tyson Larsen regarding Redistricting Saline County; Notice of a Special SENDD Board of Directors meeting on February 22nd; from the City of Crete, the Planning Commission agenda for February 15th and the February 16th agendas for the City Council, Parks & Recreation Committee, Public Works Committee and Finance Committee. At 10:00 a.m., Veteran Service Committee member Lyle Bartels and Karpisek recognized Harvey Weber with a Certificate of Appreciation. The certificate reads “The Saline County Commissioners wish to Recognize your military service to the United State of America. Throughout our Nation’s history, it is the effort of the men and women, such as yourself, that have provided the freedoms we, as Americans, dearly enjoy today. Please accept our deepest gratitude and appreciation. Let us never forget your demonstrated sacrifice, service, love and commitment to your country. Thank You, God Bless You, and God Bless the United States of America”. Mr. Weber was unable to attend due to inclement weather. Lyle Bartels reported to nominate a veteran for recognition, an application can be made with the Saline County Veteran Service office. McDermott was requested to make the application available on the Saline County website. Bartels stated the Veteran Service Committee is working with the Peacemakers to present a Quilt of Valor along with the County’s Certificate of Appreciation. Gary Veprovsky addressed the Board of Commissioners with concerns of the current Planning & Zoning Chairperson, Doug Horak not stepping back from leading the meetings when the appearance of a wind farm conflict of interest arose. Veprovsky referred to violations according to Section 5 and Section 6 in a copy of Planning & Zoning By-Laws and Regulations. Veprovsky reported Horak serving on the Wind Board as Treasurer and serving on the Planning & Zoning Board is a violation. He noted if a Board member has a conflict of interest, it needs to be brought forward before discussion begins on an issue and it needs to be recorded in the minutes. He stated he feels since Horak is the Chairperson, he needs to set an example for other members to follow. Veprovsky noted Jansky and Mary Jo Weber also have or had direct or indirect interest in the wind farms. The By-Laws Veprovsky was referring to, are not dated or signed. Veprovsky requested County legal representation at Planning & Zoning meetings. Karpisek requested Eickman look into Veprovsky’s concerns. Approved the 4 Year Community Plan for Saline County Youth Diversion; Approved the January 2021 County Clerk Fees in the amount of $28,592.40; Approved the January 2021 Clerk of the District Court Fees in the amount of $17,317.68; Approved the January 2021 Sheriff Fees in the amount of $3,204.01; Discussion of the Planning & Zoning Commission and Board of Adjustment By-Law Applicability. It was noted the County is unable to locate a signed or adopted copy of such By-Laws. County Attorney gave the opinion the County should take action to rectify and formally approve and adopt By-Laws, if they are going to be used as a method of conducting business; Approved to extend the Wind Farm Moratorium to March 31, 2021; Approved Resolution #2021-018 transferring $78,000 from the Inheritance Fund to the General Fund, to be reimbursed when funds become available; Approved Resolution #2021-019 transferring $3,500.00 from the Inheritance Fund to the Juvenile Services Aid Program to be reimbursed when funds become available; Approved Resolution #2021-020 for the One & Six Highway Improvement program; Approved change order C-76(753) from Herbst Construction, decreasing the contract sum by $35,516.55; Approved Resolution #2021-017 for Project Program Agreement – BL2106, County Bridge Match Program #5; Approved surplus property request for a 2004 Ford Dually 1-ton 4x4 pickup, a 1994 GMC ½ ton 4X4 pickup and a 2015 Ford SUV Police Interceptor; Heard updates on snow removal and the lease/purchase agreement with John Deere for a motor grader; Under Report of Officials heard reports of attending meetings with Region V Services and Region V Systems; Employee Wellness Committee; Safety Committee; Employee Recognition Banquet; Blue Valley Community Action; Ag Society; Community Service 4-year plan; Ransomware seminar; Windstream & Unite; upcoming meetings with SENDD; NACO meeting with Governor; RC&D; and the Employee Health Fair on February 23rd & 24th;
